A Hindu youth was killed in a clash between two groups during a Muharram procession in Gorakhpur on January 27, 2007. Local journalist Parwaz had filed a case on September 26, 2008, alleging that the then BJP MP Yogi Adityanath had given a speech to avenge the youth’s death. He has many videos of this speech.
After this, the state government refused to give sanction to prosecute. The applicant challenged this decision of the government in the High Court, which was rejected by the court. Later he challenged the decision of the High Court in the Supreme Court, which was also rejected by the Supreme Court.
The applicant had challenged the lower court’s decision dated October 11, 2022, in which the court had dismissed the objection petition filed against the closure report of the police in the Gorakhpur riot case.
Justice Dinesh Kumar, while dismissing the petition of Parvaz and others under Section 482 of the CrPC (powers vested in the High Court), imposed a fine of Rs one lakh. It was directed to deposit it in the Army Welfare Fund within four weeks. If this fine is not deposited, it will be recovered as arrears of land revenue from the property of the petitioner.
The court said, “The petitioner himself is facing several criminal cases and he has been fighting this case since 2007. He must have spent a huge amount on lawyers to represent the case in the lower court, the High Court and the Supreme Court.”
The court said, “His resources to fight this case should be the subject of investigation. Additional Advocate General Manish Goyal is sure that it has been set up by the forces working against the present Chief Minister of the state, Yogi Adityanath, who do not want the progress of the state and the country.
The court said, “It is up to the state to investigate this aspect. However, this court does not want to say anything further nor does it want to give any direction in this regard.
